Platform Role & Scope Flowhora operates solely as a technology and infrastructure provider for WhatsApp Business API–based messaging and automation. - We provide tools, APIs, and dashboards to enable messaging workflows. - Flowhora does not create, initiate, or send messages on behalf of users. - All message content, recipient data, templates, and campaigns are fully managed and controlled by users. - Users are solely responsible for how the platform is used. 2. User Responsibility & Conduct - Users are fully accountable for all messages sent using Flowhora. - Flowhora bears no responsibility or liability for unlawful, misleading, spam, fraudulent, or unauthorized communications. - Users must obtain valid customer consent (opt-in) before sending any messages. - Flowhora does not monitor, review, or approve message content. 3. Meta & WhatsApp Policy Compliance - Users must comply with all applicable Meta WhatsApp Business, Messaging, and Commerce Policies. - Violations may lead to template rejection, number quality issues, account restrictions, or suspension by Meta. - Flowhora has no control over Meta enforcement actions and assumes no liability for them. 4. No Guarantees on Approval or Delivery - Flowhora does not guarantee WhatsApp Business API approval, WABA activation, or template approval. - Message delivery is not guaranteed and depends on factors such as: WhatsApp and Meta infrastructure, Network conditions, Recipient device availability, Platform-level policies and limits - Service performance may vary beyond Flowhora’s control. 5. Information Accuracy - While we strive to keep our content accurate and up to date, Flowhora makes no guarantees regarding completeness or accuracy. - Users should independently verify any information critical to their business decisions. 6. Third-Party Dependencies - Flowhora relies on third-party platforms including Meta, WhatsApp, hosting providers, and payment gateways. - We are not responsible for outages, delays, downtime, policy changes, or service disruptions caused by third parties. - Any such issues are outside Flowhora’s operational control. 7. Legal & Regulatory Compliance Users are responsible for complying with all applicable laws and regulations, including: Information Technology Act, 2000, Digital Personal Data Protection (DPDP) Act, 2023, Applicable cyber security and telecom regulations - Flowhora is not liable for any legal violations committed by users. - All disputes, penalties, fines, or legal consequences arising from usage remain the user’s responsibility. 8. “As-Is” Service Provision - Flowhora services are provided on an “as-is” and “as-available” basis. - No warranties—express or implied—are provided regarding uptime, availability, performance, or uninterrupted access. 9. No Business or Financial Advice - Flowhora does not provide business, legal, financial, or marketing advice. - Analytics, reports, metrics, or insights are informational only. - All business decisions and outcomes remain the sole responsibility of the user. 10. Limitation of Liability To the maximum extent permitted by applicable law: - Flowhora shall not be liable for any indirect, incidental, special, or consequential damages. - Any total liability, if applicable, shall not exceed the fees paid by the user in the immediately preceding billing cycle. 11.
